Abstract: Tort Law in China builds a scientific and rational system of liability principle, which not only embodied legislative policies and value judgments in China, but also clarified the principle and method of liability elements, burden of proof and disclaimer subjects. Both fault presumption liability and strict liability will generate the inversion of the burden of proof.
