制定《侵权责任法》应当着重解决的若干问题

Abstract: 制定《侵权责任法》应当着重解决以下几个问题:（1）贯彻"大陆法系为体,英美法系为用,广泛吸纳司法经验"的基本指导思想;（2）确立最为实用的侵权责任归责原则体系;（3）全面规定侵权责任的构成要件;（4）对侵权行为的规定争取最大化的类型化;（5）对新型侵权行为作出具体规定。
